Terms of Service for Car Spot: Car Identifier

These Terms of Service ("Terms") govern your access to and use of Car Spot: Car Identifier (the "Service"). Please read them carefully. By downloading, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

1. Interpretation and Definitions

Interpretation

Words with capitalized initials have meanings defined below, whether used in singular or plural form.

Definitions

For the purposes of these Terms:

• Account means a user account created to access features of the Service.
• Application refers to Car Spot: Car Identifier, the mobile application provided by the Company for iOS and Android devices.
• Company ("we", "us", "our", or "AppTek") refers to AppTek, the developer and operator of the Service.
• Device means any device capable of accessing the Service, such as a smartphone or tablet.
• Guest Mode means using limited features of the Application without creating an Account.
• Service refers to the Application, its features, functionality, and any related services provided by the Company.
• Service Provider means any third party that processes data on behalf of the Company (such as infrastructure, hosting, analytics, or AI providers).
• User Content means photos, images, and other content uploaded, submitted, or created by You within the Service.
• You means the individual accessing or using the Service, or the legal entity on whose behalf such individual is accessing or using the Service, as applicable.

2. Acceptance of Terms

By downloading, accessing, or using the Application or the Service (including in Guest Mode), You confirm that You have read, understood, and agree to be bound by these Terms.

By using the Application, You confirm that You are legally permitted to enter into this agreement, or that You have obtained the consent of a parent or legal guardian where required by applicable law. The Service is intended for users of all ages. However, if You are under the age required by local law to enter into a binding agreement, You confirm that You have permission from a parent or legal guardian.

If You are using the Service on behalf of an organization or other legal entity, You confirm that You have the authority to bind that organization to these Terms.

3. Description of the Service

Car Spot: Car Identifier allows users to:

• Take or upload photos of cars;
• Identify car make, model, and year using AI-based image recognition;
• View detailed car specifications;
• Collect and organize spotted cars into collections;
• Tag car spots with GPS location data;
• Submit corrections to car identifications;
• Share spotted cars or collections via shareable links;
• Follow other users and interact with their content;
• Level up and progress based on identified cars (XP, levels, ranks, quests);
• Try limited features in Guest Mode without creating an Account.

The Service is provided for educational and hobby purposes only. We do not guarantee that identifications or other information provided by the Service are accurate, complete, or up to date. The Service is available worldwide, except in jurisdictions where its use would be prohibited by applicable law or trade sanctions.

4. AI Disclaimer

The Service uses automated and AI-based systems (including Google Gemini) to generate results. You acknowledge and agree that:

• Results are generated automatically by artificial intelligence and are not verified by humans;
• Identifications may be incorrect, incomplete, or unavailable;
• Car specifications, pricing estimates, rarity assessments, and historical information are AI-generated and may contain errors;
• The Service should not be relied upon for legal, financial, safety, valuation, insurance, or professional decisions;
• Photos submitted for identification are processed by third-party AI services (see our Privacy Policy for details).

Use of the Service is at your own risk.

5. User Accounts and Guest Mode

Certain features require creating an Account. You agree to provide accurate information, keep your credentials secure, and accept responsibility for all activity under your Account. We may suspend or terminate Accounts that violate these Terms or misuse the Service.

You may use limited features of the Service in Guest Mode without creating an Account. Guest Mode is subject to the same Terms and usage restrictions. Guest data is stored locally on Your Device and is not backed up by Us.

6. User Content and Photos

Ownership

You retain ownership of any photos or content you upload to the Service. By uploading User Content, you grant us a limited, non-exclusive, worldwide license to store, process, display, and use that content solely to operate and improve the Service. This license terminates when You delete Your content or Account.

AI Processing

By submitting photos for identification, You authorize Us to send those photos to third-party AI service providers for processing. You represent that You have the right to submit any photos You upload and that they do not infringe upon the rights of third parties.

Storage

Photos uploaded to the Service may be stored long-term to support features such as collections, progress tracking, and account synchronization.

Prohibited Content

You agree not to upload content that is illegal, offensive, abusive, or in violation of applicable laws or third‑party rights. This includes, but is not limited to, content that:

• Contains images of individuals without their consent;
• Infringes upon intellectual property rights;
• Contains malicious content or is designed to disrupt the Service;
• Is unrelated to the purpose of the Service (car identification).

Content Responsibility

User Content is provided "as is". We do not pre-screen all User Content and are not responsible for content uploaded by users. You may encounter content that you find objectionable.

We reserve the right to remove User Content that violates these Terms or applicable law, without prior notice.

Copyright Complaints

If You believe that content on the Service infringes Your copyright, You may submit a notice to Us at legal@carspot.dev with the following information:

• A description of the copyrighted work You claim has been infringed;
• A description of where the allegedly infringing material is located within the Service;
• Your contact information (name, address, email, phone number);
• A statement that You have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law;
• A statement, under penalty of perjury, that the information in Your notice is accurate and that You are the copyright owner or authorized to act on the owner's behalf;
• Your physical or electronic signature.

We will investigate and respond to properly submitted notices in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512) and equivalent laws in other jurisdictions.

7. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the Service;
• Use bots, scripts, or automated systems to access the Service;
• Scrape or harvest data from the Service;
• Use the Service to build or support a competing product;
• Abuse rate limits or security measures;
• Impersonate another person or misrepresent your affiliation;
• Use the Service for any unlawful purpose;
• Attempt to gain unauthorized access to the Service, its servers, or related systems;
• Interfere with or disrupt the integrity or performance of the Service.

We may limit usage, suspend features (including restricting access to AI-powered identification), or terminate access to prevent misuse or protect system integrity. Such restrictions may be applied with or without prior notice at Our sole discretion.

8. Free and Paid Features

The Service offers both free and subscription-based features.

Free Tier

The free version includes usage limits (such as a daily scan limit) and restricted functionality. These limits may change at any time without notice.

Subscription

Paid subscriptions unlock additional features and remove certain limitations. Detailed subscription terms, including billing, renewals, cancellations, and refunds, are provided in our Subscription Terms.

• On iOS, subscriptions are billed and managed through the Apple App Store and are governed by Apple's terms.
• On Android, subscriptions are billed and managed through Google Play and are governed by Google's terms.
• Subscriptions renew automatically unless canceled through your platform's account settings.

We do not process or store payment information directly.

9. Creator and Referral Program

The Service may offer a creator or referral program that allows users to share referral links and receive attribution for new user signups. Participation in the program is subject to additional terms that may be communicated within the Application. We reserve the right to modify, suspend, or terminate the referral program at any time.

10. Intellectual Property

All aspects of the Service, including software, design, branding, logos, and interface elements, are owned by or licensed to AppTek and protected under applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application, and to access and use the Service, for personal, non-commercial purposes.

11. Third-Party Services

The Service relies on third-party services, including AI processing (Google Gemini), cloud infrastructure (Supabase), subscription management (RevenueCat), error monitoring (Sentry), and email delivery (Brevo). We are not responsible for the content, functionality, or availability of third-party services. Your use of such services may be subject to their own terms and policies.

If any third-party service becomes unavailable or changes its terms, We may modify or discontinue features that rely on it.

12. Feedback

Any feedback you provide is non‑confidential and may be used by AppTek without restriction or compensation.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the foregoing, We do not warrant that:

• The Service will be uninterrupted, error-free, or secure;
• AI-generated identifications or specifications will be accurate;
• The Service will meet Your specific requirements;
• Defects will be corrected within any particular timeframe.

14. Limitation of Liability

To the fullest extent permitted by law, AppTek shall not be liable for:

• Incorrect or inaccurate identifications or specifications;
• Data loss or corruption;
• Service interruptions or downtime;
• Actions taken based on AI-generated information;
• Unauthorized access to Your Account resulting from Your failure to secure credentials;
• Indirect, incidental, special, consequential, or punitive damages.

Our total liability shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the claim, if any. Nothing in these Terms limits liability that cannot be excluded under applicable consumer protection laws, including liability for death or personal injury caused by negligence, or for fraud.

15. Indemnification

You agree to indemnify and hold harmless AppTek from any claims, damages, or expenses arising from:

• Your misuse of the Service;
• Your violation of these Terms;
• Your violation of applicable laws or third-party rights;
• User Content You upload or submit.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or misuse the Service. You may stop using the Service and delete your Account at any time through the Application settings. Upon termination, your right to use the Service ends immediately.

Upon Account deletion, Your data will be permanently removed in accordance with our Privacy Policy. Provisions that by their nature should survive termination (including Sections 13, 14, 15, 17, and 20) shall survive.

17. Dispute Resolution and Governing Law

You agree to first attempt to resolve any dispute with AppTek informally by contacting us at legal@carspot.dev. If a dispute cannot be resolved informally within 30 days:

• EU/EEA users: The dispute shall be subject to the exclusive jurisdiction of the competent courts of Your country of residence within the European Union.
• Users outside the EU/EEA: You and AppTek agree to resolve any dispute through binding arbitration administered under the rules of a recognized arbitration body in the jurisdiction of AppTek's principal place of business, except that either party may seek injunctive relief in any court of competent jurisdiction. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

These Terms are governed by the laws of Your country of residence. If You are a consumer in the EU, You benefit from mandatory consumer protection laws applicable in Your country. Nothing in these Terms affects Your statutory rights as a consumer. For users outside the EU, these Terms shall be governed by and construed in accordance with the laws of the jurisdiction of AppTek's principal place of business.

18. Apple App Store Disclaimer

If You downloaded the Application from the Apple App Store, these additional terms apply:

• These Terms are between You and AppTek only, and not with Apple Inc.
• Apple is not responsible for the Service or its content.
• Apple has no obligation to provide maintenance or support services for the Application.
• To the extent permitted by law, Apple shall have no warranty obligations with respect to the Application.
• Apple is not responsible for addressing any claims relating to the Application or your use of it.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against You.

19. Google Play Store Disclaimer

If You downloaded the Application from Google Play, these additional terms apply:

• These Terms are between You and AppTek only, and not with Google LLC.
• Google is not responsible for the Service or its content.
• Google has no obligation to provide maintenance or support services for the Application.
• Google's liability to You is limited to the extent required under Google Play's terms of service.

20. Changes to the Service and Terms

We may modify the Service, features, pricing, or these Terms at any time. For material changes, we will provide reasonable notice through the Application or the email address associated with Your Account. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service.

21. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, or third-party service outages.

22. Miscellaneous

• Severability: If any provision of these Terms is held to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
• Assignment: You may not assign or transfer your rights under these Terms. We may assign these Terms without restriction.
• Entire Agreement: These Terms, together with the Privacy Policy and Subscription Terms, constitute the entire agreement between You and AppTek regarding the Service.
• Survival: Provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law shall survive termination of these Terms.
